The lawsuit was filed by Paula T., a woman from Texas who was injured by the Günther Tulip® Inferior Vena Cava Filter (“IVC Filter”) manufactured by Cook Medical LLC and William Cook Europe ApS.
The IVC Filter was implanted on March 6, 2007 at Baylor All Saints Medical Center in Fort Worth, Texas by Dr. Tom Livingston for the purpose of preventing a Venous Thromboembolism (VTE).
Cook Medical is accused of negligence for selling a defective medical device and failing to warn about safety risks.
The lawsuit was filed on May 21, 2019 in the U.S. District Court for the Southern District of Indiana (Indianapolis Division) — Case No. 1:19-cv-02023-RLY-DLP.
It will be centralized with over 5,600 other IVC filter lawsuits that have already been filed in Multi-District Litigation (MDL No. 2570) — In Re: Cook Medical, Inc., IVC Filters Marketing, Sales Practices, and Products Liability Litigation.
